Terms and Conditions of Use

These Terms and Conditions govern access to and use of the Fablea.it website (hereinafter the “Site”), an educational digital project managed by EVM System S.r.l.s., with registered office at Corso Antonio Rosmini, 80 – 38068 Rovereto (TN), Italy, VAT No. 02618410225, contactable at support@evmsystem.it.

Accessing, browsing, and using the Site implies full acceptance of these Terms pursuant to Articles 1321 et seq. of the Italian Civil Code, as well as Legislative Decree 70/2003 concerning information society services. If the user does not intend to accept these conditions, even partially, they must immediately cease using the Site.

1. Scope of the Service

Fablea.it is a digital platform dedicated to the distribution of educational and cultural content, including traditional fairy tales, original stories, educational materials, interactive games, educational quizzes, audio content, and other tools aimed at the growth and cultural development of children and families.

The Site may offer both free content and content accessible through a Premium subscription, governed by specific contractual conditions published in the relevant section.

2. Permitted Use of the Site

The user agrees to use the Site in compliance with the law, morality, public order, and these contractual conditions. Any use of the Site for unlawful or unauthorized purposes is prohibited.

In particular, it is expressly prohibited to:

  • reproduce, copy, distribute, or commercially exploit the content without written authorization;
  • use automated software to extract data or content from the Site (scraping, crawling, harvesting);
  • attempt to compromise the security, integrity, or technical operation of the Site;
  • share login credentials with third parties;
  • bypass any technical or functional limitations of the service.

3. User Account

If the Site provides for the creation of a personal account, the user is responsible for the accuracy of the data provided and for safeguarding their login credentials. Any activity carried out through the account shall be deemed attributable to the account holder.

The Owner reserves the right to suspend or terminate accounts involved in fraudulent, abusive, or unlawful activities.

4. Intellectual Property

All content available on the Site (texts, images, illustrations, audio, graphic layout, logos, trademarks, source code, multimedia elements) is protected under Law No. 633 of April 22, 1941, on copyright and applicable European regulations.

Any use of public domain works, licenses, or third-party contributions is carried out in compliance with applicable regulations. Unless expressly stated otherwise, all content shall be considered protected works.

5. Content and Artificial Intelligence

Some content may be developed with the support of artificial intelligence tools used as creative assistance instruments. Any text and data mining activity, systematic data extraction, or use of the content for training artificial intelligence models without written authorization is expressly prohibited, pursuant to Article 70-quater of the Copyright Law.

6. Advertising and Third-Party Services

The Site may contain advertising content or links to third-party services (including Google, Amazon, Meta, and other advertising networks). The Owner exercises no control over such services and is not responsible for the content, policies, or any damages resulting from the use of external services.

7. Limitation of Liability

The Site and services are provided “as is” and “as available.” The Owner does not guarantee that the service will be free from errors, interruptions, or technical malfunctions.

To the extent permitted by law, the Owner shall not be liable for indirect damages, loss of profits, loss of data, or any other damages resulting from the use of the Site.

8. Governing Law and Jurisdiction

These Terms are governed by Italian law. For any dispute, exclusive jurisdiction shall lie with the Court of Rovereto (TN), without prejudice to mandatory legal provisions.

9. Reporting Intellectual Property Violations

Any reports concerning intellectual property rights violations must be sent to support@evmsystem.it indicating the specific URL, proof of ownership of the rights, and a detailed description of the alleged infringement.
